Reckless Driving Leads to Wrongful Death
A Santa Rosa woman is facing murder and reckless driving charges in connection with a car accident that killed a man in July. The accident took place on Hall Road and was allegedly precipitated by an argument between the woman and her boyfriend over his infidelity. In anger, she attempted to chase his motorcycle with her car, hitting and killing a 56-year-old man, whose family could seek a wrongful death suit.
The 29-year-old woman was also drinking that afternoon and was allegedly emotionally distraught. The revelation that her boyfriend had been cheating caused her to react in anger, eventually leading to the crash. The woman allegedly lied to California Highway Patrol officers, giving a false account of what happened in the accident.
According to a CHP investigation of the crash, the woman’s Acura approached the motorcycle at a high rate of speed. The boyfriend swerved into the opposite lane to avoid being hit, and the woman’s car struck a Lexus traveling in front of her as well as the victim’s car in front of the Lexus.
Car accidents in which someone is killed sometimes develop into wrongful death suits if the driver has been dangerously negligent, such as drinking and driving. A personal injury attorney can explain the appropriateness of a wrongful death action for individual cases. Families may be able to seek damages for wrongful death including pain and suffering, funeral costs and lost wages.
